Terms of Service

We verify Templates and present them, with their verification results, in a catalogue. We are not the creator of the Templates themselves.

We do not collect payment from Buyers. Templates are bought on the sales page designated by the Author, and the contract of sale is formed between the Author and the Buyer. We are not a party to it.

Our revenue is the listing fee we receive from Authors. We take no commission on Template sales.

Listing is free at present. Before we begin charging a listing fee, we will publish a price list and give notice.

No account is required to use the Service. Listing submissions are made by sending the submission form.

An Author may submit a Template for listing by completing and sending the submission form.

We verify submitted Templates and report the results back to the Author. Verification is free of charge and there is no limit on the number of submissions.

Passing Verification does not entitle an Author to a listing; whether to list remains our decision. We are under no obligation to state our reasons for declining to list.

For the purpose of Verification we will fetch the submitted repository, install its dependencies, run its build, and issue measurement requests against its demo site. By submitting, the Author consents to this.

A verification report records measurements taken at the time of Verification. It is not a guarantee of future behaviour, performance or security.

Speed Score is the median of three runs on a fixed profile. Real-world results vary with the deployment environment, network conditions and content.

An “untested” entry in the Runtime Matrix means neither that the Template fails on that runtime nor that it works on it.

Verification follows a procedure we define, and that procedure may be updated without notice.

Copyright and all other rights in a Template remain with its Author.

What a Buyer may do with a Template is governed by the license type set for it and by the license terms the Author defines. We are not a party to those license terms.

By submitting a Template for listing, the Author grants us permission to use its name, description, screenshots and verification results to display and promote the Service.

An Author pays a listing fee to have a Template listed. The amount is set by the price list we publish.

We invoice the listing fee only after we have notified the Author that the Template passed Verification. If it does not pass, no listing fee is charged.

The listing fee is charged once, at the point of listing. There is no further charge for the listing to remain up.

We will not list a Template until payment of the listing fee is confirmed.

Listing fees are non-refundable once paid, except where the Template could not be listed for reasons attributable to us.

Paying a listing fee does not affect any tax obligation arising from selling the Template. The obligation to declare and pay such tax rests with the Author.

The buy button on a product page takes the Buyer to the sales page designated by the Author. We do not operate that sales page.

The terms of the transaction there — payment, delivery of the Template, returns and refunds — are entirely between the Author and the Buyer. We are not involved in them and accept no responsibility for them.

The price shown on a product page is a reference value declared by the Author at the time of listing, and may differ from the actual price on the sales page. Check the sales page before buying.

An Author who changes the price or the terms of sale on their sales page shall notify us.

Where a sales page is unavailable for a prolonged period, or where a Buyer reports a serious problem that we confirm, we may suspend the listing.

The following are prohibited when using the Service.

Where the preceding article is breached, or where we otherwise judge a listing to be inappropriate, we may suspend or remove it without prior notice.

An Author may ask for their Template to be delisted. Delisting does not affect transactions already concluded.

We do not warrant that the Service or any listed Template is fit for a particular purpose, accurate, complete, or that it will continue to be available.

We are not liable for loss arising from use of the Service, except where caused by our wilful misconduct or gross negligence.

Where we are liable, that liability is limited to ordinary loss actually incurred, and in no event exceeds the listing fee we received in respect of the Template concerned.

The two preceding paragraphs do not apply to the extent they would be void under the Consumer Contract Act or any other mandatory provision of law.

We may change what the Service provides, and may suspend or discontinue it.

We may suspend the Service without prior notice for maintenance, in the event of a fault, or for any other unavoidable reason.

We may amend these Terms where we consider it necessary. Amended Terms take effect when they are posted on this page.

Where an amendment would materially affect users, we will give notice of when it is to be posted.

These Terms are governed by and construed in accordance with the laws of Japan.

The Tokyo District Court shall have exclusive jurisdiction in the first instance over any dispute between us and a user arising in connection with the Service.
